None of the names, trademarks, service marks and logos of Vinyl Me, Please appearing on this Site may be used in any advertising or publicity, or otherwise to indicate Vinyl Me, Please’s sponsorship of or affiliation with any product or service without express written permission of Offbeat Ventures, LLC. Nothing contained on the Site should be construed as granting, by implication, estoppel, waiver or otherwise, any license or right of use to any trademark displayed on the Site without the written permission of the owners and operators of vinylmeplease.com or the third party owner of the trademark, if any. This Site may contain other proprietary notices and copyright information, the terms of which must be observed and followed.

Vinyl Me, Please makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, and non-infringement of intellectual property or other violation of rights. Further, Vinyl Me, Please does not warrant or make any representations concerning the accuracy, completeness, or reliability of the information and materials on this Site or on any site linked to it. The materials on Vinyl Me, Please’s Site are provided “as is” and “as available”.

In no event shall Vinyl Me, Please or its suppliers be liable for any direct, indirect, incidental, special, consequential or punitive damages arising out of the use or inability to use this Site, notwithstanding that Vinyl Me, Please or a Vinyl Me, Please-authorized representative may have been notified orally or in writing of the possibility of such damage. You agree to indemnify, defend and hold harmless Vinyl Me, Please and its respective affiliates, employees, officers, directors, agents, servants and representatives from any liability, loss, claim, suit, damage, and expense (including reasonable attorneys´ fees and expenses) related to (i) your violation of these terms and conditions and (ii) your posting of material to this Site.

9. Right to Change Terms and Conditions

Vinyl Me, Please may from time to time change or add to these terms and conditions. Any changes to these terms and conditions will be effective immediately upon posting of the changed terms and conditions on the Site. You agree to review these terms and conditions periodically, and use of the Site following any such change constitutes your agreement to follow and be bound by the terms and conditions as changed.

10. Governing Law

These terms and conditions and the resolution of any dispute related to them shall be construed in accordance with the laws of the State of Colorado. Any dispute between Vinyl Me, Please and you related to these terms and conditions shall be resolved exclusively by the state and federal courts of the State of Colorado.

11. International Shipping

By ordering goods from Vinyl Me, Please destined to EU-member states specifically, services will be provided to you only after you explicitly agree to become Importer of Record (“IOR”) and as such customs clearance shall be made in your name and on your behalf. As IOR, you agree to be ultimately responsible for importing the products ordered by you into the destination EU-member state and are solely responsible for the payment of duties, and taxes either at the time of sale if prepayment is selected or at the time of importation if prepayment is not selected. You hereby give a proxy or power of attorney (“POA”) to Vinyl Me, Please’s designated shipping provider for the customs clearance of products ordered by you. This POA authorizes Vinyl Me, Please’s designated shipping provider’s assigned customs broker to act on behalf of you Vinyl Me, Please’s designated shipping provider’s intervention with respect to customs formalities may be done by a customs agent assigned by Vinyl Me, Please’s designated shipping provider on your behalf. You hereby acknowledge to have understood the concept of IOR and the need of the POA and further state that the terms of the POA or terms of the purchase from Vinyl Me, Please and transportation conditions from Vinyl Me, Please’s designated shipping provider are not unreasonable or unknown to you, that you have read them, understood them and further have agreed to them.

12. Mobile Program Terms of Service

The VMP mobile message service (the "Service") is operated by Vinyl Me, Please (“VMP ”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply.

Text messages may be sent using an automatic telephone dialing system or other technology. Your consent to receive autodialed marketing text messages is not required as a condition of purchasing any goods or services. If you have opted in, the Service provides transactional messages: updates, alerts, and information (e.g., order updates, account alerts, etc.) and promotional messages: promotions, specials, and other marketing offers (e.g., cart reminders) from VMP via text messages through your wireless provider to the mobile number you provided. Message frequency varies. Text the single keyword command STOP to +1 (833) 680-1096 to cancel at any time. You'll receive a one-time opt-out confirmation text message. We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. You agree to maintain accurate, complete, and up-to-date information with us related to your receipt of messages.

You agree to indemnify, defend, and hold us harmless from any third-party claims, liability, damages or costs arising from your use of the Service or from you providing us with a phone number that is not your own.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

13. Vinyl Me, Please Membership Referral Program

From your Vinyl Me, Please account, you can invite non-members to join the membership at a discount. A non-member is a person who is not an active Vinyl Me, Please member and has not received any membership referral credit in the past 365 days. If your invitee joins Vinyl Me, Please, you will receive a credit towards your membership fee (the “Referral Fee”) based on which membership your invitee selects: U.S. members will receive $20 on 3-month signups, $40 on 6-month signups, and $80 on 12-month signups. International members will receive $25 on 3-month signups, $50 on 6-month signups, and $99 on 12-month signups. Vinyl Me, Please may adjust the amount of these credits at any time in its sole discretion, to be applied on future Referral Fees.

The Referral Fee is a one-time discount. If you accrue multiple Referral Fees through multiple referrals, we will credit those Referral Fees towards your Vinyl Me, Please future membership fees. The Referral Fee is non-transferable, has no intrinsic value, and may not be exchanged for cash or other goods or services. To be eligible to receive a Referral Fee, you must be a current Vinyl Me, Please member. Referral Fees for memberships activated after your membership will remain tied to your account and may be used towards your membership reactivation . If the amount of Referral Fees exceeds the amount of your membership fee, your membership fee for the applicable period will be $0 and the balance of your Referral Fee will be applied to your next membership fee. Any invitee canceling their membership will not affect your Referral Fee. We reserve the right to withhold the Referral Fee if we determine in our sole judgment that your invitee is likely you or another non-qualifying invitee (such as, without limitation, a current Vinyl Me, Please member using different contact information).

14. Vinyl Me, Please Store Referral Program

Anyone (doesn’t have to be an existing customer) can invite a new shopper to make a purchase from the VMP store at a discount. To be eligible, the invitee must have never purchased from the VMP store before. The invitee will get $10 off a store purchase of $50 or more. If the invitee makes the $50+ purchase, you will receive $10 in store credit. The discount value is subject to change and can easily change with promotions, etc. There is no limit to how many people you can refer (subject to change). Invitee cannot share your email or IP address or one that has shopped from our store before. Invites do not expire.

This Privacy Policy describes Vinyl Me, Please’s (also herein “our” or “we”) practices regarding the online collection and use of your personal information, including your rights with respect to that personal information. By visiting our Site, or the website of any affiliated company, you agree to be bound by the terms of this Privacy Policy. Do not use this Site if you do not agree to this Privacy Policy. As used herein, “personal information” means information that is linked or reasonably linkable to an identified or identifiable individual; personal information does not include de-identified information or publicly-available information.

This Privacy Policy DOES NOT apply to information that:

• We collect offline or through any other services; or
• You provide to or is collected by any third party, whether you access any third-party app or website via the Site. Those websites and apps may have their own privacy policies, which we encourage you to read before providing information on or through them.

Information We Collect

Personal Information. Vinyl Me, Please collects your personal information when you voluntarily provide it to us in connection with your subscription, including your name, address, email address, payment and billing information. We also collect login credentials (a username and password) that allow you to create an account. Note that all credit card payments are processed by a third-party vendor via a secure link and, as a result, Vinyl Me, Please does not collect or store any credit or payment information.

Device Information. Vinyl Me, Please’s website uses “cookies”, including web beacons, pixels, and similar technologies, to collect information about how our site is used. We may also make use of “persistent or memory based” cookies, which remain on your computer’s hard drive until you delete them. Examples include our use of cookies to pre-populate forms you complete on our website based on information you have previously provided to us, enable interest-based advertising and collect information about your web browsing history. We also place advertising cookies that share information about your site behavior and purchasing history with third party advertisers. Those advertisers may use that data to serve advertisements to you off our Site. To opt out of 

Vinyl Me, Please uses the services of Google Analytics, and may use other similar services, to collect and analyze statistical data about visitors to our website. We also use Facebook advertising services, including a remarketing function, and may use other similar services, to arrange for you to see Vinyl Me, Please advertisements when you visit certain third party websites. 

We partner with Microsoft Clarity and Microsoft Advertising to capture how you use and interact with our website through behavioral metrics, heatmaps, and session replay to improve and market our products/services. Website usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of products/services and online activity. Additionally, we use this information for site optimization, fraud/security purposes, and advertising. We generally use cookies and similar technologies as follows: 

• for “essential” or “functional” purposes, such as to enable various features of the Site like remembering passwords or staying logged in during your session;
• for social media integration e.g., via third-party social media cookies, when you share information using a social media sharing button on our Site, or when you engage with our content on or through a social networking website such as Meta or X;
• for analytics purposes, consistent with our legitimate interests in how our Site is used or performs, how users engage with and navigate through the Site, what sites users visit before visiting our Site or how often they visit our Site, and other similar information;
• subject to any consent required by law, for the purpose of displaying advertisements via retargeting to those users who have visited our Site, or for advertising to visitors to our Site; and
• subject to any consent required by law, for the purpose of analyzing your feedback on our products on other platforms.

We do not perform targeted advertising as such term is defined by the Colorado Privacy Act. While we may display advertisements to you on or off the Site, those advertisements are based on your interaction with the Site itself and not on your behavior across websites or applications.

How We Use Information

Internal Uses. Vinyl Me, Please may use your personal information to (1) provide you with the services and products you request, (2) assist its third-party vendors in processing payments for those services or products; (3) contact you about products or services that we offer; (4) send you our weekly newsletter if you sign up for it; (5) conduct customer surveys with your consent; and/or (6) conduct internal cohort analyses to better refine the services and our marketing efforts. On occasion, we may also contact you to inform you of offers from third parties which may be of interest. We may also create anonymous information from your personal information; we are the sole owner of this anonymous information and may use or share it for any purpose permitted by applicable law so long as it does not contain any personal information and none may be extracted from it.

Disclosure of Information to Third Parties. Except as set forth in this Privacy Policy, we will not disclose any personal information to any third party (excluding our contractors to whom we may provide such information for the limited purpose of providing services to us and who are obligated to keep the information confidential), unless (1) you have authorized us to do so; (2) we are legally required to do so, for example, in response to a subpoena, court order or other legal process; (3) it is necessary to protect our property rights related to this website; and/or (4) to enforce our Terms and Conditions. We also may share aggregate, non-personal information about website usage with unaffiliated third parties. This aggregate information does not contain any personal information about our users.

In addition, if Vinyl Me, Please is acquired by or merged with another company, we reserve the right to transfer or assign the personal information it has collected from you as part of such merger, acquisition, sale, or other change of control.

GDPR Compliance

Transferring Personal Data From The EU To The US. Vinyl Me Please is located in the United States. Information we collect from you will be processed in this country. The United States has not sought nor received a finding of “adequacy” from the European Union under Article 45 of the General Data Protection Regulation (GDPR). In an attempt to comply with the GDPR’s requirements, Vinyl Me, Please collects and transfers to the U.S. personal data (as defined in the GDPR) only: with your consent; to perform a contract with you; or to fulfill a compelling legitimate interest of Vinyl Me, Please in a manner that does not outweigh your rights and freedoms. Vinyl Me, Please endeavors to apply suitable safeguards to protect the privacy and security of your personal data and to use it only consistent with your relationship with Vinyl Me, Please and the practices described in this Privacy Policy. Vinyl Me, Please also minimizes the risk to your rights and freedoms by not collecting or storing sensitive personal data about you.

Advertising.  You can obtain more information about our advertisers’ companies’ information collection practices, and opt-out of receiving interest-based advertising from participating NAI and DAA members at http://www.networkadvertising.org/managing/opt_out.asp and/or the DAA’s website at optout.aboutads.info.  

Mobile app users may opt out of receiving interest-based advertising in mobile apps provided by participating members of the Digital Advertising Alliance by installing the AppChoices mobile app, available at https://www.youradchoices.com/appchoices.  

You can also limit collection of your personal information for interest-based ads by blocking third party cookies in your browser settings or using privacy plug-ins or ad blocking software that help you block third party cookies.  In addition, your mobile device settings may provide functionality to limit use of the advertising ID associated with your mobile device for targeted online advertising purposes.  If you opt-out of interest-based advertisements, you will still see advertisements online but they may be less relevant to you.

Some of the third party advertising companies we work with offer their own opt-out options that you can use to limit their use of your information for interest-based advertising, such as Google (opt-out).  Please note that we also may work with companies that offer their own opt-out mechanisms or do not participate in the opt-out mechanisms described above. Even after using these opt-out mechanisms, you may receive interest-based advertising from other companies.

Data Subject Rights. The GDPR provides certain rights to online users located in EU countries, referred to in the regulation as “data subjects.” If you wish to confirm that Vinyl Me, Please is processing your personal data, or wish to access personal data Vinyl Me, Please may possess about you, please contact us at info@vinylmeplease.com. Data Security

Vinyl Me, Please uses industry standard measures to maintain the security of your personal information both during data collection and data storage. We retain personal information only for as long as needed for the purposes indicated in this Privacy Policy or for such other period as may be permitted or required by law. While we strive to protect your personal information, we cannot ensure or warrant the security of any information you transmit to us or receive from us. You acknowledge and assume the risk when communicating with us that security of your online information may be compromised. Vinyl Me, Please does not control and is not responsible for practices of any third-party websites that users may be linked to from our site.

Children Under 13

Vinyl Me, Please does not knowingly collect personal information from children under the age of 13 without verifiable parental consent. If it is determined that such information has been inadvertently collected from anyone under the age of 13, we shall immediately take steps to ensure that such information is deleted from our database and servers. Anyone under the age of 13 must obtain parent or guardian permission to use our website. If you believe we have obtained the personal information of your child, please contact us at info@vinylmeplease.com to request deletion of that information.

Updates to this Policy

We reserve the right to amend or update our Privacy Policy. We will provide you notice of amendments to this Privacy Policy, as appropriate, and update the “Last Modified” date at the top of this Privacy Policy. Your continued use of our Site and/or services confirms your acceptance of our Privacy Policy, as amended. If you do not agree to our Privacy Policy, as amended, you must stop using our Services.
